Terms & Conditions
1. PARTICIPANT
1.1 Open to UK residents aged 16 years or over, excluding employees and their immediate families of O2, its subsidiary companies, their agents and anyone else professionally connected with the promotion.
1.2 By registering to participate, participants agree to be bound by these terms and conditions.
2. SIM REQUESTS
2.1 The promotion is only open to customers who possess a promotional O2 Pay & Go sim requested as part of the activity during the promotional period. All tariffs included.
2.2 The closing date for sim requests is 24 September 2010, or earlier if 65,000 sims are requested.
2.3 Maximum of 4 promotional Pay & Go sims per household.
3. TOP-UP AND TEXT
3.1 In order to enter the promotion, you must top up a promotional sim with a minimum of £10 and text CASH to 66102 (UK texts are free).
3.2 You will then receive a text from O2 containing a registration code to use at o2goals.co.uk. Please make a note of this code as you will need to use it again when claiming your reward.
3.3 Each sim can only be used once to enter - one registration code per qualifying sim.
4. REGISTRATION
4.1 You must register your code at o2goals.co.uk.
4.2 Registration is live from 1 September 2010 up to the kick off time of your chosen team and fixture occurring on or before 3 October 2010 (The Registration Period). We can’t accept registrations outside of the Registration Period.
4.3 The kick off time will be taken as the official scheduled kick off time. Any registrations for a match made after kick off time will not be recorded. E.g. If a match officially scheduled to kick off at 15:00 does not actually kick off until 15:05, you must have registered for that match by 15:00. A registration at 15:02 would not be recorded successfully.
4.4. On registration, you will be asked to select a league, team and date of preferred fixture. Once you have selected a team and fixture during registration it cannot be changed.
4.5 Leagues, teams and fixtures available will be decided by the Promoter.
4.6 ‘Team’ refers to English and Scottish top flight football clubs. These are referenced as a 3 to 5 letter acronym which represents the full name of the football club.
4.7 You will be eligible to receive £10 for every goal your chosen team scores in your selected fixture.
4.8 Only officially recorded goals will count towards your total reward. Disallowed goals and own goals scored by a player on your selected team in favour of the opposition are excluded.
4.9 The name inputted at the point of registration will be the one featured on the payment cheque. This name is final and cannot be changed at any point so please ensure it is spelt correctly.
4.10 You can register sims at o2goals.co.uk at any time during the Registration Period, but only goals scored after the sim is registered and during the chosen fixture will be counted towards your final reward total. You will not receive any rewards for goals scored before the promotional sim has been registered, or during any other fixture between 1 September and 3 October 2010.
4.11 The exact time of registration is decided by the Promoter.
5. CLAIMING
5.1 Reward provided as a cheque.
5.2 To claim, you must revisit o2goals.co.uk after 3 October 2010, login (using your registration code), print off, complete and send the downloadable Claim Form to “O2 Football Promotion”, Dept 5867, PO Box 99, Aylesbury, Bucks, HP19 8RR.
5.3 Claim Forms must be received no later than 13 October 2010.
5.4 O2 accepts no responsibility for any loss and/or damage to the claim in the post and/or any delay in the postal service. Any claim received late will not be processed. Please be aware that proof of posting is not proof of receipt. You are advised to use a secure and guaranteed method of delivery for a claim.
5.5 If the claim is valid, a cheque will be sent to you within 28 days. The cheque will be made payable to the name registered and posted to the address on the Claim Form.
5.6 You will need to ensure that you have a bank or building society account into which you can pay a cheque and you are responsible for all bank charges relating to the paying in of the cheque to that account.
5.7 Incomplete or fraudulent claims will be disqualified.
5.8 If O2 considers that a registration/claim is invalid and/or incomplete it will be rejected. Customers will not be informed that their invalid and/or incomplete claim has been rejected.
5.9 The cash reward shall be calculated on the basis of £10 for each goal scored by your selected team in the fixture you select following registration for the promotion.
5.10 The total value of the cash reward will be calculated by O2 on receipt of a valid claim certificate.
5.11 It is your responsibility to cash the cheque as soon as possible and whilst it is still valid. No replacement cheques will be issued.
5.12 O2’s decision is final and no correspondence will be entered into.
6. PROMOTER
6.1 The promoter is Telefónica O2 UK Limited, 260 Bath Road, Slough, Berkshire, SL1 4DX (“O2”). Registered No.01743099.
7. DISCLAIMERS
7.1 This promotion is not endorsed by, authorised by or affiliated with any of the leagues or any of the football clubs in question.
7.2 O2 shall not be liable for any failure to fulfil this offer where such failure is caused by any supervening circumstances amounting to force majeure. Such circumstances shall include, but shall not be limited to, severe weather conditions, fire, flood, war, earthquake, riots, industrial dispute, terrorism, acts of God, ash clouds, supervening legislation, or events which, without the fault of either party, render performance impossible or incapable of satisfactory execution. If for any reason the applicable football fixtures are delayed, the time periods for this promotion will be extended and you will find details of the revised time periods on the website o2goals.co.uk.
7.3 Sometimes, through reasons outside of O2’s control, the website (as with any website) may be not be accessible, we will have no liability for any loss arising out of such an event. We would advise you to register as soon as possible, and if at any point whilst using or trying to use the website you have issues with accessing or using the website we would advise you to try again later.
7.4 O2 reserves the right to terminate this promotion immediately at any time and without notice if circumstances make this unavoidable. However, O2 will continue to operate the promotion in respect of those persons who have registered promotional sims prior to the termination date.
7.5 O2 may at its absolute discretion disqualify any registrations or claims which O2 reasonably feels do not comply with these terms and conditions or where any form of bad faith is suspected.
8. JURISDICTION
8.1 These terms and conditions are governed by English law and come under the exclusive jurisdiction of the English courts, except where any contract is made in Scotland, in which case it will be governed by Scottish law.
